This service is operated by State of Your Art. A company based and registered in New York City, the state of New York, USA, with operation centers in NYC & London. This website allows you to order for postal delivery, the production of photographs & illustrations on canvas. You can also choose to upload your own images to our service system.
The images and designs used on the State of Your Art section of the free gallery and artists gallery files are the property of State of Your Art and their respective copyright owners and are used by State of You Art with express authorization. You must not use, reproduce, modify or distribute our images or any part of those images in any manner. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be ordered, which will prevent any further use or distribution of the image until a final court hearing.
These terms and conditions apply to all customers/visitors, and form the basis of every agreement made between us and you (the customer). Please read these Purchase Terms carefully because they form a contract between State of Your Art and our customers. These conditions may be modified by us at any time and supersede all previous terms and conditions published on this site. Ordering Services
Eligibility
By using the Services, you represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are eighteen (18) years of age or older; and (d) your use of the Services does not violate any applicable law or regulation. Your State of Your Art Account (the “Account”) may be deleted without warning if we believe that you are younger than eighteen (18).
Eligibility; Credit Card Terms
To order any product, you must be at least eighteen (18) years of age or the applicable age of majority in your jurisdiction. You will be required to give us a valid credit card number (VISA, MasterCard, American Express or any other issuer then accepted by us) and associated payment information at the time you order a canvas or any other products hereunder, including all of the following: (i) your name as it appears on the card, (ii) the credit card type, (iii) the date of expiration of your credit card, (iv) billing address, and (v) any activation numbers or codes needed to charge your card. State of Your Art currently does not accept any other payment form. You agree that no additional notice or consent is required before State of Your Art invoices the credit card for all amounts due and payable. By providing State of Your Art with your credit card number and associated payment information, you agree that State of Your Art is authorized to immediately invoice your account for all fees and charges due and payable to State of Your Art as a result of your purchase. You agree to immediately notify State of Your Art of any change in your billing address or the credit card used for payment hereunder.
Fees and Charges
You agree to pay all fees and charges incurred in connection with your orders (including any taxes imposed on your orders but not limited to, sales, use or value-added taxes). When you order for overseas delivery, you may be subject to import duties and taxes, which are levied when the package arrives at the destination that you specified. Any charges for customs clearance have to be borne by you, as State of Your Art has no control over such charges and cannot foresee the amount charged (if any). Since customs policies vary from country to country, you should contact the customs office in the country where you have us ship your package to get more information.
Password
When you sign up to become a Member, you will also be asked to choose a username and a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the Account, username, or password of another Member at any time. You agree to notify State of Your Art immediately if you suspect any unauthorized use of your Account or access to your password. You are solely responsible for any and all use of your Account. We recommend you choose a different password than the one you use for your email account.

Return Policy
Under the distance selling Regulations, if you have received goods and have simply changed your mind about purchasing them, you may return goods for credit subject to the following conditions:
'Upload Your Own'
All artworks are provided as a made to order service to the client on a one to one basis, based on the designs shown on this site. You, as the customer give the artist responsible full creative title to recreate the said artwork based on your size and style requests to the best of his/her ability.
Damaged items will be exchanged free of charge. We reserve the right to charge for re-posting returned orders, which have been especially produced to meet your personal requirements.
Damages
Full refunds will be made by State of Your Art for items lost or damaged in transit. You should keep all packaging and/or artwork as found and notify us within 2 days of the item arriving in damaged condition to be eligible for a full refund or exchange.

Law and jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without reference to its conflicts of laws provisions. Jurisdiction for litigation of any dispute, controversy or claim arising out of or in connection with this Agreement, shall be only in a federal or state court having subject matter jurisdiction located in Queens County, New York
Should any dispute arise concerning any matter referred to in this Agreement, prior to commencing action in the courts, the parties shall first attempt to settle the matter by appointing an independent mediator, selected and agreed to by both parties.
Release. You hereby release State of Your Art, its officers, employees, agents and successors from claims, demands any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to or arises from any interactions with other Users.
Indemnity. You agree to defend, indemnify, and hold State of Your Art, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Services in violation of this Agreement and/or arising from your breach of any provision of this Agreement.

Ordering Services
- 1. We shall use all reasonable endeavors to maintain the quality and operational status of the website, and online services which we may provide to you, although accept no liability for losses of any kind, including but not limited to economic or goodwill losses during periods of maintenance, planned or unplanned.
- 2. Once you have placed an order for any goods via this web site, the order will not be treated as having been accepted until you receive confirmation from us that this is the case. This confirmation may be by email. For the customer, any order is legally binding after having agreed to these terms of purchase.
- 3. If you have placed an order for multiple prints of an image, State of Your Art may contact you before your order is shipped. In some cases, we reserve the right to send customers a single print for their approval before we ship the remaining of the order.

Prices
- 1. All indicated prices are including taxes but excluding packaging and posting. US residents of NY State are subject to 8.35% sales tax.
- 2. Costs for postage and packaging will be calculated separately during the order process.
- 3. All indicated prices apply to the date of an order. By updating our website, all previous price lists become invalid. The relevant prices are those which applied to the date of an order.
- 1. The order will be delivered to the delivery address stated and confirmed by the customer during the order process. The customer is responsible for the correct and complete statement of the delivery address.
- 2. Delivery times are stated as a guide only. We cannot be responsible for items delayed or lost due to courier failure.

- Goods are returned in a re-saleable condition and in their original packaging

- 1. We reserve the right not to reproduce any images or other material which contain offensive or inappropriate content.
- 2. In submitting the order form on the 'upload your own' section, the customer confirms that they own the rights to their respective photo or have obtained the relevant written permission. You retain all intellectual property rights, including copyright, to the images that you have submitted to us for reproduction.
- 3.We claim no ownership of the intellectual property in your images, but you grant us a royalty-free license to store, print, download, copy, post, or distribute your images in the course of our business or contracts with you.
- 4. You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses arising out of any claim regarding infringement of any third party's copyright, trade mark or other intellectual property rights due to the processing, printing or other dealing with by us in accordance with our stated services by you or on your behalf.
- 5. We reserve the right to refuse any further services to anyone who breaches these terms.
- 1. Personal data provided to us through this web site will only be used in accordance with our privacy policy. Please read through this carefully before proceeding. By providing your personal data to us you are consenting to its use in accordance with our privacy policy.
- 2. As a general rule the information which you supply will be processed purely for the purpose(s) for which it is supplied and collected. However, we may on occasion use your information for the purpose of providing information to you about special offers, services, products and features on our website which we consider may be of interest to you and for other related marketing purposes. We may share your information with reputable third parties for the purposes of fulfilling any order which you may make.
- 3. Our web site logs information about your visit that is automatically recognized by the Web server, such as the link that brought you to us (i.e. a link from a search engine). They also provide information about the pages you visited whilst on the site. We use this information for internal review to improve the content of our web site.
